Personal Data Protection Law

As ATAK MADENİ YAĞ PAZARLAMA SANAYİ VE TİCARET A.Ş. (“ATAK”) ”), we, provide maximum sensitivity for the protection of your personal data. In recognition of this fact, we attach great importance to the processing and storing of every personal data of every kind of person with whom we are associated, in accordance with the Personal Data Protection Law No. 6698 (“PDPL”). To fully execute these responsibilities, we process your personal data as a “Data Controller” to the extent provided by law and as defined in the KVKK, as described below.

In this Disclosure Text;

  • Personal Data refers to: any information relating to an identified or identifiable natural person,
  • Personal Data Protection Law (“PDPL”) refers to: Personal Data Protection Law No. 6698, entered into force upon promulgation in the Official Gazette on 07.04.2016,
  • Data Controller refers to: the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system,
  • Data Processor refers to: the natural or legal person who processes personal data on behalf of the data controller upon its authorization,

Data Controller:

Your personal data that you share as an interested party, supplier, customer, employee, trainee, visitor, etc. under the PDPL will be evaluated by the entity named ATAK as the data controller in accordance with the context set forth below.

  • Collection, Processing and Business Purposes of Personal Data

Your personal data may differ depending on your relationship with our company but may be collected verbally, in writing, or electronically, by automated or non-automated means, through our business units, websites, social media channels, mobile applications, and similar means. Your personal data is collected, updated, and processed for as long as your relationship with us is in effect.

Your personal data is collected in accordance with the terms and conditions and for the purposes of data processing set out in Articles 5 and 6 of the KVKK for ensuring that the necessary work is carried out by the relevant business units in order to provide you with the benefits of our services, to ensure the legal and commercial security of our company and those with whom we have business relationships, to define and execute our strategy, and to manage the Human Resources Policy of our Company. Your personal data shall be processed:

  • In good faith and in full compliance with the law,
  • With accuracy and relevance when required,
  • For specific, explicit, and legitimate purposes,
  • In an adequate, limited, and proportionate manner for the purposes of data processing,
  • For a period of time as required by applicable law or as strictly necessary for the purposes of data processing.

 

  • To whom and for what purpose the processed personal data is transferred:

Your personal data is transferred to our partners, suppliers, legally authorized public institutions, and natural persons in accordance with the terms and conditions and for the purposes of data processing set out in Articles 8 and 9 of the PDPL for ensuring that the necessary work is carried out by the relevant business units in order to provide you with the benefits of our services, to ensure the legal and commercial security of our company and those with whom we have business relationships, to define and execute our strategy, and to manage the Human Resources Policy of our Company.

  • Technical Method and Legal Grounds for Collecting Personal Data:

Your personal data is collected through any form of verbal, written, or electronic means in order to provide you with our services for the aforementioned purposes and to fully and accurately fulfill our contractual and legal obligations. Your personal data collected for these legitimate purposes may be processed and transferred within the conditions and purposes of personal data processing set out in Articles 5 and 6 of the PDPL and for the purposes set out in Articles (1) and (2) hereof.

  • Rights of the Data Subject as specified in Article 11 of the PDPL:

As a data subject, you may submit a request regarding your rights to our company in any of the ways listed below, and we will respond to your request within 30 days, free of charge, depending on the nature of the request. However, in the case of a claim by the Personal Data Protection Authority, a fee will be charged at a rate determined by our company. In this context, personal data subjects have the following rights;

  • To learn whether personal data is being processed,
  • If they were processed, to demand information on that,
  • To learn the processing purpose of personal data, and whether these are used for their purposes,
  • To learn about third persons to whom the personal data were transferred domestically or abroad,
  • In the case that the personal data are processed incompletely or incorrectly, to request their correction,
  • To ask for the deletion or destruction of your personal data in line with such terms set out in the 7th article of PDPL.
  • In accordance with subparagraphs (e) and (f), to request that the transaction be reported to the third persons to whom the personal data were transferred,
  • To object to a result against the person via analysis of processed data exclusively by automatic systems,
  • If a loss is incurred due to unlawful processing of personal data, to request the damage to be indemnified.

Pursuant to paragraph 1 of Article 13 of the PDPL, you may submit a request to exercise the above rights to our Company in writing or in any other manner specified by the Personal Data Protection Authority. Since the Personal Data Protection Authority is yet to specify any options at this stage, your request must be submitted in writing to us in accordance with the PDPL. In this regard, the channels and procedures for submitting a written request to us in accordance with Article 11 of the PDPL are as follows.

In order to exercise the above rights and to obtain the necessary information to verify your identity and to exercise the rights set forth in Article 11 of the PDPL, you must submit a request, in writing and signed by hand, mailed or notarized, stating in a clear and understandable manner the rights you wish to exercise and attaching documents that verify your identity and your address details, to either info@atak.com.tr or Yeşilköy Mah.
